Het kan wonderlijk lopen in de wereld. Het noorden van Brazilië is een tijd lang in Nederlandse handen. Later zouden de Portugese voorouders van de Probandus zich er onder Portugees bewind vestigen. De nazaten kregen aldaar de Braziliaanse nationaliteit. De Braziliaanse grootvader van de Probandus trouwt eerst met een dame uit Engeland die aanvankelijk de Britse nationaliteit bezit. Als het huwelijk uit elkaar valt, neemt zij hun Braziliaanse zoon mee naar Europa, alwaar hij op 16 jarige leeftijd de Britse nationaliteit aanneemt en zij op late leeftijd de Nederlandse nationaliteit! De grootvader van de Probandus zal later hertrouwen en emigreert naar Amerika, alwaar hij zelf Amerikaans staatsburger wordt.

De moeder van de Probandus is in Nederlandsch Indië geboren en bezit vanaf haar geboorte de Nederlandse nationaliteit (het Koninkrijk der Nederlanden).

De Probandus zelf is geboren in Johannesburg en bezat vanaf zijn geboorte de Zuid Afrikaanse nationaliteit. Zijn ouders wilden, mede gelet op het licht ontvlambare Apartheids regime, dat hij toch de nationaliteit van zijn vader zou krijgen, die vanaf zijn 16e jaar de Britse nationaliteit bezat. Dit mocht, enkel tot de tweede generatie die buiten het land worden geboren. De Probandus heeft in 1996 de Nederlandse nationaliteit gekregen naast zijn Britse. Er is feitelijk bij hem sprake van ´dual nationality´. Aanvankelijk bleek hij bij de aanvraag van de Nederlandse nationaliteit meerdere vreemde nationaliteiten te bezitten en werd de aanvraag afgewezen. Het bleek zo te zijn dat als je in Zuid Afrika uit één of twee ouders met de Nederlandse nationaliteit geboren wordt, je de nationaliteit niet verliest als je een andere nationaliteit aanneemt. Er is derhalve in 1996 afstand gedaan van die Zuid Afrikaanse nationaliteit.

Het Nederlanderschap wordt van rechtswege verkregen door de geboorte uit een Nederlandse vader of Nederlandse moeder, ongeacht de plaats van geboorte (artikel 3, eerste lid, RWN: het ius sanguinis-beginsel). Omdat in zeer veel landen deze zelfde regel van gelijkheid van vader en moeder in het nationaliteitsrecht bestaat, krijgen kinderen uit internationale huwelijken vrijwel steeds zowel de nationaliteit van de vader als van de moeder. Bovendien kent een aantal landen - waaronder de VS - de regel dat geboorte op het grondgebied nationaliteit meebrengt (het ius soli-beginsel), en zal een kind uit Nederlandse ouders, dat in een ius soli-land geboren is, dus eveneens een dubbele nationaliteit hebben.

As the world turns, history takes shape and strange events happen. The north of Brazil was, for some time in Dutch hands. Later the Portuguese ancestors of the Probandus would settle there under Portuguese rule. Their descendants would get the Brazilian nationality after it became part of the Brazilian Empire. The Brazilian grandfather of the Probandus first marries with a lady from England. She initially had the British nationality. When the marriage falls apart, she takes her Brazilian son to Europe. She eventually would live in The Netherlands and acquire the Dutch nationality. Her son becomes a British national when he is sixteen years old in 1936! The grand father of the Probandus emigrates to America and he himself would become an American citizen.

The mother of the Probandus was born in the Dutch Indies and has had the Dutch nationality (the Kingdom of the Netherlands) by birth.

The Probandus himself was born in Johannesburg and initially had the South African nationality. Due to the slightly inflammable Apartheids regime, his parents decided to emigrate to Spain. They wanted the Probandus to have the same nationality as his father. This was possible only up to the second generation which is born outside the country. Besides his British nationality, the Probandus has also acquired the Dutch nationality in 1996 (dual nationality). Initially he appeared to have several ‘foreign’ nationalities when he applied for the Dutch nationality. Consequently the application was rejected. Research proved that there was an ancient law stating that if you are born in South Africa and one or two of your parents have the Dutch nationality, you do not lose the South African nationality if you adopt another nationality. Therefore in 1996 the Probandus had to state that he no longer wished to have the South African nationality.

Note: The Dutch nationality is by right obtained by the birth from a Dutch father or Dutch mother, irrespective of the place of birth (Article 3, first paragraph, RWN: the ius sanguinis principle). Because in very many countries this same rule of equality of father and mother exists in the nationality law, children from international marriages nearly always get both the nationality of the father and of the mother. Moreover a number of countries - among which the US - have the rule that one acquires the nationality of the country that they are born in (the ius soli- principle), and a child from Dutch parents, who are born in an ius soli-land, therefore have dual nationality.
